Nurse Acquitted of Dishonesty and Drug-Taking on Ward.

Darren Snow, instructed by Zach Jones of the Royal College of Nursing Exeter secured the acquittal of band 6 nurse JC on 7 of 8 charges before the Nursing & Midwifery Counsel, alleging that he had consumed patient medication and stolen further medication for his own consumption whilst working as a charge nurse and acting ward manager.

The allegations were all rejected by the Panel. Evidence at the hearing revealed a poor internal investigation by the Trust and an irregular employers’ disciplinary process where findings of fact were made against this nurse without the panel having questioned a single witness making the allegations.

Evidence at the NMC proceedings from the Registrant and another nurse who had worked with him on the ward described a toxic atmosphere over the period of the allegations with a culture of homophobic abuse by some staff, including those making the allegations, aimed at gay male nurses. The case resumes in November to deal with impairment and sanction on the one charge found proved. Nurse JC remains in unrestricted practice in the meantime.
